Spanish-Language ‘Know Your Rights’ Presentations
Immigration and Custom Enforcement (ICE) has begun immigration raids to detain immigrant individuals and families from Central America who have been denied refugee status. It is imperative that immigrant women and families know and understand how to exercise their rights during interactions with immigration and law enforcement officials.
La migra (ICE) viene haciendo redadas para detener y deportar individuos y familias de Centroamérica que la corte ha denegado su petición de estatus de refugiado. El objetivo de estos talleres es para que nuestra comunidad inmigrante sepa sus derechos y como ejercitarlas cuando interactúa con agentes del ICE y autoridades policiales.
KNOW YOUR RIGHTS (Prepared By Not One More):
1. Memorize the number of two people you trust, who know that they are your contact, and who can answer the phone at any time.
2. Have an emergency plan for child care or care for people who need special attention.
3. Make contact with a community group now. Better to organize before immigration comes than after.
4. If ICE comes to your house, do not open the door, even if they show you a photo of the person they’re looking for, whether you know that person or not.
5. ICE cannot enter your house without an order (arrest warrant) signed by a judge. You do not have to open the door nor let them in.
– If they have an order, ask them to pass it under the door.
– If they have an order signed by a judge, check to make sure it has your address or the specific name of the person they’re looking for.
6. Stay quiet. Anything you say can be used against you by ICE.
7. Do not give any information or sign any paper without first talking to an attorney.
8. Document the raid. Take photos, ask for names, get identification numbers, count the agents that are there, and write or document what happened.
9. You can fight your case. Obtain advice or representation from a competent attorney and seek help from local community organizations. Just because you have a final deportation order doesn’t mean that you don’t have any options. Even though it is difficult, sometimes there is the chance to put pressure on immigration to use their discretion, especially with the help of experienced community organizations.
CONOZCA SUS DERECHOS:
1. Memorice el numero de 2 personas de confianza que sepan que son sus contactos y que le puedan contestar el teléfono en cualquier momento.
2. Tenga un plan de emergencia para el cuidado de los niños o de personas que requieran atención especial.
3. Haz contacto con un grupo comunitario ahora. Mejor organizar antes que llega la migra que después.
4. Si ICE va a su casa, no abra la puerta, aunque le enseñen una foto de la persona a la que busca, los conozca o no.
5. ICE no puede entrar a su casa sin una orden (orden de cateo) firmada por un juez. No tiene que abrir su puerta ni dejarlos entrar.
– Si llevan orden, pídales que se la pasen por debajo de la puerta
– Si ICE lleva una orden firmada por un juez, revise que tenga su dirección o el nombre especifico de la persona a la que buscan.
6. Permanezca callada/o. Cualquier cosa que diga puede ser usada en su contra por ICE.
7. No de información ni firme ningún papel sin primero consultar con su abogada/o.
8. Documente la redada Tome fotos, pregunte nombres, el numero de su identificación, cuente los agentes que estén presentes y escriba o documente lo que paso.
9. Puede pelear su caso Obtenga consejos o representación de un abogado de confianza y busque recursos con organizaciones comunitarias locales. Solo por qué tiene una deportación final no significa que no tenga opciones. Aunque es difícil, a veces hay oportunidad de poner presión a inmigración para que use su discreción, especialmente con el apoyo de organizaciones comunitarias con experiencia.
